წესები და პირობები

 

გთხოვთ, ყურადღებით გაეცნოთ აქ მოცემულ წესებს, რადგან თქვენ მიერ ამ ვებ გვერდზე განხორციელებული ნებისმიერი ქმედება ავტომატურად გულისხმობს, რომ თქვენ ეთანხმებით ამ წესებსა და პირობებს. რა თქმა უნდა, თქვენ გაქვთ არჩევანის თავისუფლება, თუ არ ეთანხმებით რომელიმე პირობას/წესს, თქვენ შეგიძლიათ არ ისარგებლოთ ვებ გვერდით შემოთავაზებული ნებისმიერი სახის მომსახურებით ან/და შესაძლებლობით. დეტალური ინფორმაცია ვებ გვერდის, მისი ადმინისტრაციის და თქვენი უფლებების და მოვალეობების შესახებ შეგიძლიათ იხილოთ ქვემოთ.

წესების და პირობების შესახებ შეთანხმების მხარეები:

ჩვენ – ვებ გვერდი/ვებ გვერდის ადმინისტრაცია/ვებ გვერდის მესაკუთრე – შპს „ბუდეშური“ (ს/კ 404597897), შემდგომში მოხსენიებული, როგორც „LTD BUDESHURI”, „მომსახურების მიმწოდებელი/მიმწოდებელი“, „ვებ გვერდი“, „ვებ გვერდის ადმინისტრაცია“, „მომსახურების გამწევი“ და „პლატფორმა“. budeshuri.com არის შპს „ბუდეშურის“ საკუთრება. 

თქვენ –  მომხმარებელი, 18 წელს მიღწეული ფიზიკური პირი ან იურიდიული პირი, რომელსაც ნებისმიერი ტექნიკური საშუალებით აქვს წვდომა წინამდებარე ვებ გვერდზე. შემდგომში მოხსენიებული, როგორც „მომხმარებელი“, „დამკვეთი“, „მომსახურების მიმღები“ და „კლიენტი“.

მომხმარებელი შესაძლებელია იყოს სერვისის დამკვეთი, მას შემდგომ რაც ვებ გვერდზე გაივლის ავტორიზაციას/რეგისტრაციას. მხოლოდ რეგისტრირებულ მომხმარებელს აქვს უფლება ისარგებლოს ვებ გვერდის იმ მომსახურებით, რომელიც გულისხმობს ვებ გვერდზე განთავსებული პროდუქციის შეძენის გამარტივებული ხერხით სარგებლობას. ვებ გვერდზე რეგისტრაცია, შეუძლია მხოლოდ 18 წელს მიღწეულ ფიზიკურ პირს, შესაბამისად თუ თქვენ რეგისტრირდებით წინამდებარე ვებ გვერდზე ადასტურებთ რომ ხართ სრულწლოვანი. 

ვებ გვერდის მომხმარებელი, შესაძლებელია იყოს ვებ გვერდთან მომსახურების ხელშეკრულებით დაკავშირებული პირი, რომელიც ვებ გვერდზე მოცემული პლატფორმის მეშვეობით ახორციელებს თავის სამეწარმეო საქმიანობას. ასეთი პირი შესაძლებელია იყოს, მხოლოდ საქართველოს კანონმდებლობით დადგენილი ყველა მოთხოვნის შესაბამისად სერტიფიცირებული (შესაბამისობის სერთიფიკატი) და უფლებამოსილებით აღჭურვილი მეწარმე სუბიექტი / ღვინის კომპანია (ფიზიკური/იურიდიული პირი), რომელიც აწარმოებს ყურძნისეული წარმოშობის ალკოჰოლიან და სპირტიან სასმელს. 

 

 

ტერმინთა განმარტება:

ღვინის კომპანია – „მეწარმეთა შესახებ“ საქართველოს კანონით ან/და იმპორტიორი ქვეყნის კანონმდებლობით განსაზღვრული მეწარმე სუბიექტი (ფიზიკური/იურიდიული პირი), რომლის სამეწარმეო საქმიანობა უკავშირდება ღვინის, სპირტიანი სასმელის, სპირტის, ყურძნის ტკბილის და ყურძნის წვენის წარმოებას ან/და რეალიზაციას; მოცემულ ხელშეკრულებაში შესაძლებელია მოხსენიებული იყოს, როგორც „პარტნიორ(ებ)ი“, „ღვინის კომპანი(ებ)ი“, „მეღვინეები“, „ღვინის მაღაზია“, „პროდუქციის მწარმოებელი/მწარმოებელი“.

შესაბამისობის სერთიფიკატი (სერთიფიკატი) – სსიპ ღვინის ეროვნული სააგენტოს მიერ გაცემული დოკუმენტი, რომელიც დასტურებს, რომ პროდუქციის ხარისხობრივი მაჩვენებლები და თვისებრივი ახასიათებლები შეესაბამება მევენახეობა-მეღვინეობის დარგის მარეგულირებელ, საქართველოს კანონმდებლობით გათვალისწინებულ მოთხოვნებს;

პრეამბულა:

  • წინამდებარე წესები და პირობები არეგულირებს ვებ გვერდზე მოცემული მომსახურების გამოყენებას და განსაზღვრავს მის სამართლებრივ ფარგლებს. წინამდებარე ვებ გვვერდით სარგებლობა ავტომატურად გულისხმობს, რომ LTD B-ს და მომხმარებელს შორის დადებულია წინამდებარე ხელშეკრულება/შეთანხმება, რომელსაც აქვს იურიდიული ძალა. 

  • ნებისმიერი საკითხი, რომელიც ეხება ვებ გვერდსა და მისი მომხმარებლის ურთიერთობას რეგულირდება საქართველოს კანონმდებლობით, მიუხედავად მომხმარებლის უშუალო ადგიმდებარეობისა ან/და რომელი ადგილმდებარეობიდან განხორციელდა შეკვეთა, ანგარიშსწორება, მიწოდება ან/და წვდომა ვებ გვერდზე. 

  • გასათვალისწინებელია, რომ არ აქვს მნიშვნელობა რომელი ტექნიკური საშუალებით ახდენს მომხმარებელი ვებ გვერდზე წვდომას, მის მიერ ნებისმიერი განხორციელებული ქმედება განიხილება ამ წესების და პირობების ფარგლებში. 

  • აქედან გამომდინარე, ვებ გვერდზე მკაცრად განისაზღვრება წესი, რომლის მიხედვით Budeshuri.com-ზე რეგისტრაცია შეუძლია მხოლოდ 18 წელს მიღწეულ ფიზიკურ პირს, რაც გულისხმობს, რომ მომხმარებელი რეგისტრაციისას ადასტურებს, რომ ის არის სრულწლოვანი. 

  • მომხმარებელი ვალდებულია რეგისტრაციისას/ავტორიზაციისას მიაწოდოს/წარადგინოს ვებ გვერდზე ზუსტი და სწორი ინფორმაცია. 

  • Budeshuri გააჩნია ექსკლუზიური უფლებამოსილება ერთპიროვნულად შეცვალოს თავის ვებ გევრდზე არსებული პროდუქციის ფასები/რაოდენობა, გააუქმოს ან/და დაამატოს ნებისმეირი პროდუქტი/ინფორმაცია, წინამდებარე წესები და პირობები და სხვა ვებ გვერდთან აფილირებული საკითხი მომხმარებლის დამატებითი/წინასწარი ინფორმაციის მიწოდების გარეშე. რა თქმა უნდა, ნებისმიერი წესი და პირობა მხოლოდ მას შემდგომ იქნება ძალაში, რაც გამოქვეყნდება საჯაროდ და როდესაც ნებისმიერ მომხმარებელს შეკვეთის გაფორმების წინ ექნება საშუალება გაეცნოს მას. 

 

ვებ გვერდზე განთავსებული პროდუქცია აკმაყოფილებს საქართველოს კანონმდებლობით დადგენილ მოთხოვნებს, სერტიფიცირებულია და ნებადართულია რეალიზაციისთვის.

ვებ გვერდზე რეგისტრირებული დამკვეთი უკვეთავს მიმწოდებელს განთავსებული პროდუქციიდან სასურველ პროდუქტ(ებ)ს, სასურველი რაოდენობით, ხოლო მიმწოდებელი უზრუნველყოფს დამკვეთის მიერ შეკვეთილი პროდუქტ(ებ)ის მიწოდებას.

რეგისტრაცია

ყველა მომხმარებელს შეუძლია დარეგისტრირდეს Budeshuri.com -ზე და შექმნას საკუთარი პროფილი, რომლის მეშვეობითაც მას შეეძლება შეუკვეთოს პროდუქცია და მიიღოს იგი სასურველი მიწოდების სერვისით. მომხმარებელმა ანგარიშის შექმნისას უნდა მიუთითოს სწორი ინფორმაცია, მათ შორის: მომხმარებლის სახელი/გვარი, პირადი ნომერი/საიდენტიფიკაციო კოდი, ელ.ფოსტის მისამართი, ტელეფონის ნომერი, საბანკო ბარათის მონაცემები და სხვა პერსონალური მონაცემები. ჩვენი მომსახურებით სარგებლობისთვის მნიშვენლოვანია პერსონალური მონაცემების ჩვენთვის გაზიარება, რადგან მათ გარეშე ვერ შესრულდება მომსახურება.

მომხმარებელი ვალდებულია არ გადასცეს მესამე პირებს ვებ გვერდზე შექმნილი პროფილის მონაცემები და არ დააყენოს საფრთხის წინაშე მისი ანგარიშის მართვა. იმ შემთხვევაში თუ კი თქვენ (მომხმარებლის) მიერ რაიმე სახით პროფილის მონაცემების გაზიარებით მოგადგებათ ნებისმიერი სახის ზიანი, Budeshuri არ იქნება ამ და მსგავს საკითხებზე პასუხისმგებელი. თქვენ უნდა უზრუნველყოთ თქვენი ანგარიშის კონფიდენციალურობა და არ დაუშვათ მასზე წვდომა ჰქონდეს მესამე პირებს.

 

შეკვეთის გაფორმება

შეკვეთის გასაფორმებლად აუცილებელია, მომხმარებელი დარეგისტრირებული იყოს ვებ გვერდზე. მომხმარებელი ირჩევს სასურველ პროდუქტს და აფორმებს შეკვეთას. შეკვეთის განხორციელების და მიწოდების საფუძველია დამკვეთის მიერ შეკვეთის მიხედვით შესაბამისი ღირებულების ასახვა მიმწოდებლის საბანკო ანგარიშზე.

დამკვეთი ვალდებულია შეკვეთის გაფორმებისას ზუსტად და უნაკლოდ მიუთითოს სასურველი პროდუქტ(ებ)ი, მისი რაოდენობა და პროდუქტ(ებ)ის მიღებისთვის/ჩაბარებისთვის საჭირო ინფორმაცია. მომხმარებლის მიერ შეკვეთაში მითითებული ტელეფონის ნომერზე მომხმარებელს უნდა შეეძლოს ზარების მიღება, წინააღმდეგ შემთხვევაში მიწოდება შესაძლებელია გაუქმდეს.

Budeshuri  თავის მომხმარებელს სთავაზობს შემდეგ ხერხებს, იმ შემთხვევაში თუ მათ მიერ შეცდომით დაფიქსირდა შეკვეთა: 

თუ დამკვეთმა შეცდომით მიუთითა შეკვეთის მიწოდების ადგილმდებარეობა, დამკვეთი ვალდებულია შეკვეთის განხორციელებიდან არაუგვიანეს 24 საათისა დააზუსტოს მისამართი. 

იმ შემთხვევაში, თუ დამკვეთმა შეცდომით განახორციელა შეკვეთის გაფორმება (იგულისხმება პროდუქტ(ებ)ის და მათი რაოდენობის არჩევა) ვალდებულია, დაუყოვნებლივ, მაგრამ არაუგვიანეს შეკვეთის გაფორმებიდან 24 საათის განმავლობაში, აცნობოს მიმწოდებელს დაშვებული შეცდომის შესახებ და დააზუსტოს მისი შეკვეთა. 

*ზემოაღნიშნული პირობები არ მოქმედებს თბილისში სწრაფი მიტანის სერვისის გამოყენებისას. 

გთხოვთ, გაითვალისწინოთ, რომ მიუხედავად ზემოაღნიშნულისა დამკვეთის მიერ დაშვებულ ნებისმიერი ტიპის შეცდომაზე/დაუდევრობაზე/გაუფრთხილებლობაზე (და არა მხოლოდ) პასუხისმგებლობა ეკისრება თავად დამკვეთს. 

დამკვეთს უფლება აქვს გააუქმოს შეკვეთა, მხოლოდ იმ შემთხვევაში თუ შეკვეთის გაფორმებიდან გასულია არაუმეტეს 1 საათისა. აღნიშნულ დროში გაუქმებული შეკვეთის საფასური დამკვეთს დაუბრუნდება, შეკვეთის გაუქმებიდან 7 (შვიდი) დღის ვადაში. 

*დამკვეთს არ აქვს უფლება გამოიყენოს ზემოთ მითითებული წესები და გააუქმოს შეკვეთა, რომელიც გაფორმდა სწრაფი მიტანის სერვისით.

ჩვენ ვითვალისწინებთ მომხმარებელთა უფლებებს, შესაძლო დაშვებულ შეცდომებს და შესაბამისად ვადგენთ მსგავსი საკითხების ორივე მხარისთვის სასაგებლო გადაწყვეტის პოლიტიკას.

 *ამიტომ, გთხოვთ გაითვალისწინოთ, რომ აქ მოცემული წესების დარღვევით გაუქმებული შეკვეთის შემთხვევაში Budeshuri არ არის ვალდებული აუნაზღაუროს დამკვეთს პროდუქტ(ებ)ის და მისი მიწოდების მომსახურების საფასური.

მიწოდების პირობები

შეკვეთის მიწოდება ხდება დამკვეთის მიერ მითითებულ მისამართზე, მიწოდებისთვის საჭირო და დადგენილ ვადებში. შეკვეთის მიწოდება ხდება საქართველოს მასშტაბით ქვემოთ მოცემულ ვადებში. ასევე, პროდუქტის ტრანსპორტირება შესაძლოა განხორციელდეს მსოფლიოს მასშტაბით ასეთი შემთხვევისთვის დადგენილი შესაბამისი წესის მიხედვით.

მომხმარებელს შეუძლია აირჩიოს საქართველოს მასშტაბით შეკვეთის მიწოდების სერვისის ქვემოთ მოცემული ვარიაციებიდან სასურველი:

სტანდარტული მიტანის სერვისი – პროდუქტ(ებ)ის მიეწოდება დამკვეთს, შეკვეთის განხორციელებიდან არაუგვიანეს 72 საათის (3 დღე)  განმავლობაში.

სტანდარტული მიტანის სერვისი –  შეკვეთის მიწოდება განხორციელდება დამკვეთის მიერ შეკვეტის გაფორმებიდან 5 დღის განმავლობაში.

*მსოფლიოს მასშტაბით პროდუქტ(ებ)ის მიწოდების შესახებ დაკვეთის განხორციელება და მიწოდების პირობები დარეგულირდება უშუალოდ Budeshuri-თან ქვემოთ მოცემულ საკონტაქტო მონაცემებზე დაკავშირებით. ნებისმიერი საკითხი, რომელიც შეეხება მსოფლიოს მასშტაბით პროდუქტ(ებ)ის შეძენა/მიწოდების ურთიერთობას და მისგან გამომდინარე სხვა საკითხები დარეგულირდება საქართველოს კანონმდებლობით და აქ მოცემული წესების და პირობების მიხედვით, რომელიც შეესაბამება განსახილველ შემთხვევებს, მიუხედავად იმისა, თუ სერვისის შეკვეთა რა გეოგრაფიული ადგილმდებარეობიდან განხორციელდა, რა ტექნიკური ან/და სხვა საშუალებით (სატელეფონო/ელ. ფოსტის ან/და ნებისმიერი ხერხი, რომელიც მხარეთა შორის შეთანხმდა და ადასტურებს მათ შეკვეთის გაფორმებას) მოხდა შეკვეთის გაფორმება, მისი ანგარიშსწორება ან/და შეკვეთის მიწოდება. დამკვეთის მიერ აღნიშნული სერვისით სარგებლობა ავტომატურად გულისხმობს, რომ იგი თანახმაა ზემოთ აღნიშნულ პირობაზე, რომ ვებ გვერდსა და მას შორის წინამდებარე ვებ გვერდის პროდუქციასთან/მომსახურებასთან დაკავშირებით არსებული საკითხები დაექვემდებარება მხოლოდ საქართველოს კანონმდებლობას აქ მოცმეული წესების თანახმად.

დამკვეთი ვალდებულია შეკვეთაში მიუთითოს ისეთი საკონტაქტო ნომერი/მონაცემი, რომლზეც შეუზღუდავად შეუძლია წვდომა, სულ მცირე იქამდე, სანამ შეკვეთა არ მიეწოდება. ასევე, ვალდებულია შეკვეთაში დააფიქსიროს, ისეტი მისამართი  სადაც ფაქტობრივად იმყოფება იქამდე სანამ არ მიიღებს და ჩაიბარებს შეკვეთას. გამონაკლის შემთხვევებში დამკვეთს აქვს ვალდებულება დროულად და გონივრულ ვადებში აცნობოს მიმწოდებელს ნებისმიერი ცვლილების შესახებ, რათა ხელი არ შეეშალოს მას შეკვეთის მიწოდების სერვისის ჯეროვნად/კეთილსინდისიერად განხორციელებაში. თუ, შეკვეთის მიწოდების მისამართის ცვლილება განხორციელდება ისეთ დროს, როდესაც კურიერი უკვე ადრესატის იმ მისამართისკენ გაემართა, რომელიც მისთვის იყო ცვლილებებამდე ცნობილი, შემკვეთი ვალდებულია გადაუხადოს Budeshuri-ს საკურიერო მომსახურების საფასური. 

თუ დამკვეთმა არასწორად/არასრულად მიუთითა მისამართი ან/და მიწოდების რომელიმე პირობა, ასეთი ამანათის ჩაუბარებლობაზე პასუხისმგებლობა არ ეკისრება მიმწოდებელს. ასეთი შემთხვევისას, პროდუქტ(ებ)ი ბრუნდება მისი გაცემის პუნქტში. 

თუ დამკვეთს კიდევ ერთხელ სურს პროდუქტ(ებ)ის მიღება, რადგან პირველი მცდელობისას მის მიერ არასწორად/არაზუსტად მითითებული იყო მიწოდების მისამართი, საკონტაქტო ინფორმაცია ან/და კურიერის ადგილზე მისვლის შემთხვევაში დამკვეთი არ იყო ადგილზე, მიუხედავად კურიერის მიერ დამკვეთის გაფრთხილებისა, შესაბამისად ხელმოერედ იხდის მხოლოდ მიწოდების დადგენილ საფასურს. დამკვეთს ასევე შეუძლია დაუკავშირდეს მიმწოდებელს ვებ გვერდზე განთავსებულ საკონტაქტო ინფორმაციის მეშვეობით და თავად გაიტანოს პროდუქტ(ებ)ი მათი გაცემის პუნქტიდან, თუ ასეთი არის შესაძლებელი. მიმწოდებელი არ განახორციელებს არანაირ ქმედებას, სანამ დამკვეთი თავად არ დაუკავშირდება და არ დააზუსტებს მიწოდების მისამართს, მონაცემებს ან/და არ აირჩევს ხელმოერედ პროდუქტის მიღების წესს. ასეთ შემთხვევებში, როდესაც მიუწოდებლობა არ გამომდინარეობს მიმწოდებლის ბრალით პროდუქტის საფასური უკან არ ბრუნდება, ხოლო პროდუქტის გატანა/მიღება დამკვეთს მისი ნების და შეთავაზებული ხერხების მეშვეობით შეუძლია აქ დადგენილი წესებით და პირობებით. თუ მომხმარებელი შეძენილ პროდუქტს არ გაიტანს/არ ჩაიბარებს მისი შეკვეთიდან 1 (ერთი) თვის განმავლობაში, აღნიშნული ვადის გასვლის შემდგომ პროდუქტი ისევ მიმწოდებლის საკუთრებად ითვლება. 

Budeshuri-ის ვებ გვერდზე განთავსებული ინფორმაცია მუდმივ რეჟიმში განახლდება მომხმარებლისთვის მაქსიმალური კომფორტის შესაქმნელად. თუმცა, თუ გამონაკლის შემთხვევებში ტექნიკური ხარვეზის ან/და სხვა გარემოებიდან გამომდინარე შეკვეთის მიღების დადასტურების მიუხედავად შეკვეთაში მითითებული პროდუქციის მიწოდება შეუძლებელი იქნება, Budeshuri დაგიკავშირდებათ შეკვეთის დადასტურებიდან 2 საათის განმავლობაში და ეცდება შემოგთავაზოთ საუკეთესო ალტერნატივა ან/და დაგიბრუნებთ შეკვეთის საფასურს (იმ ფარგლებში, რა ფარგლებშიდაც ვერ განხორციელდება პროდუქტის მიწოდება). 

ანგარიშსწორების პირობები

მომხმარებელი რეგისტრაციისას ავსებს მოთხოვნილ გრაფებს, რომელიც გულისხმობს მისი საბანკო ანგარიშის მიბმას, რათა მომხმარებელმა შეძლოს შეკვეთის განხორციელება და ამისთვის საჭირო შესყიდვის განხორციელება.

რეგისტრირებული/ავტორიზებული მომხმარებელი თავისი ანგარიშიდან ახდენს სასურველი პროდუქტის შერჩევას და მიყვება ვებ გევრდის წესების მიხედვით შეძენისთვის საჭირო ინსტრუქციას. შეკვეთის განხორციელებისათვის შეკვეთის საფასურის ანგარიშსწორებისთვის ირჩევს სასურველი ბანკის მომსახურებას, და შეჰყავს ბარათის მონაცემები, რომელთა მეშვეობით განხორციელდება შესაბამისი ტრანზაქცია Budeshuri-ის ანგარიშზე. შესაბამისად Budeshuri სარგებლობს მესამე პირის, ანუ გადახდის პროვაიდერის მომსახურებით, რათა თქვენი ანგარიშსწორება განხორციელდეს. Budeshuri-ის ანგარიშზე თანხის ასახვის მომენტიდან Budeshuri შეუდგება ადრესატისთვის გადასაცემი პროდუქციის გამზადებას!

წინამდებარე წესებსა და პირობებში მოცემულ შემთხვევებში, როდესაც მიმწოდებელმა შეკვეთის თანხა უნდა დაუბრუნოს დამკვეთს, ასეთი სახის ანგარიშწორება მიმწოდებლისგან განხორციელდება მხოლოდ იმ საბანკო მონაცემებზე, რომლიდანაც შესრულდა მომსახურების საფასურის გადახდა ან/და მითითებული იყო დარეგისტრირებულ პროფილზე შეკვეთის განხორციელების მომენტში.

მხარეთა უფლებები და მოვალეობები

Budeshuri/მიმწოდებელი მზად არის:

  • მიაწოდოს დამკვეთს/მომხმარებელს შეკვეთით გათვალისწინებული პროდუქცია, დამკვეთის მიერ არჩეული მიწოდების ხერხით და ვადაში, შეკვეთაში დაფიქსირებულ მისამართზე;

  • მიაწოდოს დამკვეთს შეთანხმებული ხარისხის პროდუქცია;

  • მიაწოდოს ინფორმაცია დამკვეთს თავისი შეკვეთის სტატუსის შესახებ;

  • უზრუნველყოს მომხმარებლის გამართული წვდომა ვებ გვერდზე, გარდა გაუთვალისწინებელ/უკონტროლო გამონაკლის შემთხვევებისა;

  • აუნაზღაუროს დამკვეთს მისი ბრალით მიუწოდებელი შეკვეთის საფასური;

მომხმარებელი მზად არის:

  • გააკონტროლოს და დაიცვას საკუთარი ანგარიში მესამე პირებისგან და მისი უკანონო მოხმარებისგან;

  • მიაწოდოს ვებ გვერდს მისი პიროვნების შესახებ მხოლოდ ნამდვილი და სწორი ინფორმაცია და არ დაუშვას მონაცემთა გაყალბება;

  • მუდმივი წვდომა ჰქონდეს იმ საკონტაქტო ინფორმაციებზე, რომელსაც მიუთითებს პროფილის შექმნისას; წინააღმდეგ შემთხვევაში Budeshuri პასუხს არ აგებს ასეთ საკონტაქტო ბმულზე მისთვის გაზიარებული ინფორმაციის მიუღებლობაზე და ჩაითვლება რომ დამკვეთს მიეწოდა და ეცნობა ასეთი გაგზავნილი/მიწოდებული ნებისმიერი ინფორმაცია;

You are the user, an individual or legal entity over the age of 18 who has access to this website through any technical means. Hereinafter referred to as "User", "Customer", "Service Recipient" and "Client".

 

The user can be a customer of the service, after he passes the authorization/registration on the web page. Only the registered user has the right to use the services of the web page, which means using the simplified way of purchasing the products posted on the web page. Registration on the web page can only be done by an individual who has reached the age of 18, therefore if you register on this web page you confirm that you are of legal age. 

 

The user of the web page can be a person connected to the web page by a service contract, who carries out his business activities through the platform provided on the web page. Such a person can only be an entrepreneurial entity / wine company (physical/legal entity) certified in accordance with all the requirements established by the legislation of Georgia (certificate of compliance) and equipped with authority, which produces alcoholic and alcoholic beverages of grape origin. 

 

Definition of Terms:

 

Wine company - an entrepreneurial entity (natural person/legal entity) defined by the Law of Georgia "On Entrepreneurs" and/or the legislation of the importing country, whose entrepreneurial activity is related to the production and/or sale of wine, alcoholic beverages, alcohol, grape sweet and grape juice; This Agreement may be referred to as "Partner(s), "Wine Company(s), "Winemakers", "Wine Store", "Producer/Manufacturer".

 

Certificate of Conformity (certificate) – a document issued by the National Wine Agency of the State Winery, which confirms that the quality indicators and quality characteristics of the products comply with the regulatory requirements of the field of viticulture and winemaking, provided for by the legislation of Georgia;

 

Preamble:

 

  • These terms and conditions regulate the use of the services provided on the website and determine its legal scope. The use of this website automatically implies that the present contract/agreement has been entered into between Budeshuri and the user, which has legal force. 

  • Any issue related to the relationship between the web page and its user is regulated by the laws of Georgia, regardless of the direct location of the user and/or from which location the order, payment, delivery and/or access to the web page was made. 

  • It should be noted that no matter what technical means the user accesses the web page, any action taken by him will be considered within the framework of these terms and conditions. 

  •  Therefore, the web page strictly defines the rule according to which registration on Budeshuri can be done only by individuals who have reached the age of 18, which means that the user confirms that he is of legal age during registration. 

  • The user is obliged to provide/submit accurate and correct information on the web page during registration/authorization. 

  • Budeshuri has the exclusive authority to unilaterally change the prices/quantities of the products available on its website, cancel and/or add any product/information, these terms and conditions and any other website-affiliated matter without providing additional/prior information to the user. Of course, any terms and conditions will only be effective after they are published publicly and when any customer has the opportunity to familiarize themselves with them before placing an order. 

 

The products posted on the web page meet the requirements established by the legislation of Georgia, are certified and allowed for sale.

 

The customer registered on the web page orders the desired product(s) from the products posted by the supplier, in the desired quantity, and the supplier ensures the delivery of the product(s) ordered by the customer. The product will be delivered to the customer by Winestory couriers.

 

Registration

 

All customers can register on Budeshuri and create their own profile, through which they can order products and receive them with the desired delivery service. When creating an account, the user must provide correct information, including: username/surname, personal number/identification code, email address, phone number, bank card details and other personal data. You have the right not to register or use the Winestory service and not share your personal data with us accordingly. However, in order to use our services, it is important that you share personal data with us, because without them the services cannot be performed.

 

The user is obliged not to transfer the profile data created on the website to third parties and not to endanger the management of his account. In case you (user) suffer any kind of damage by sharing profile data in any way, Budeshuri will not be responsible for these and similar issues. You must ensure the confidentiality of your account and do not allow third parties to access it.

 

The above conditions also apply to the accounts of those business entities who use the platform and have registered their wine shop/company.

 

placing an order

 

To place an order, the user must be registered on the website. The user selects the desired product and places the order. The basis for order implementation and delivery is the customer's transfer of the corresponding value according to the order to the supplier's bank account.

 

The customer is obliged to specify the desired product(s), its quantity and the information required for receiving/handover of the product(s) accurately and flawlessly when placing the order. The customer must be able to receive calls on the phone number specified by the customer in the order, otherwise the delivery may be canceled.

 

Budeshuri offers its customers the following options in case they have placed an order by mistake: 

 

If the customer indicated the delivery location of the order by mistake, the customer is obliged to specify the address no later than 24 hour after placing the order. 

 

In the event that the customer made a mistake in placing the order (meaning the selection of the product(s) and their quantity), he is obliged, immediately, but no later than within 24 hour after placing the order, to inform the supplier about the mistake made and clarify his order. 

 

Please note that notwithstanding the above, any type of error/negligence/negligence (and not only) committed by the customer shall be the responsibility of the customer. 

 

The customer has the right to cancel the order, only if no more than 1 hour has passed since the order was placed. The fee for the order canceled within the mentioned time will be returned to the customer within 3 (three) days after the cancellation of the order. 

 

* The customer does not have the right to use the rules specified above and cancel the order placed with the delivery service.

 

We take into account the rights of users, possible errors and accordingly establish a policy of a win-win solution for such issues.

 

 *Therefore, please note that in the event of an order canceled in violation of the rules herein, Budeshuri is not obligated to reimburse the customer for the product(s) and its delivery service.

 

Terms of delivery

 

The order is delivered to the address specified by the customer, within the time frame required for delivery. The order is delivered throughout Georgia within the time frame below. Also, the transportation of the product may be carried out worldwide according to the relevant rules established for such case.

 

The customer can choose from the following variations of the order delivery service throughout Georgia:

*Order fulfillment and delivery terms for worldwide delivery of product(s) will be arranged directly with Budeshuri at the contact details below. Any matter related to the worldwide purchase/delivery of the product(s) and other matters arising therefrom shall be governed by the laws of Georgia and the terms and conditions contained herein, which are relevant to the cases in question, regardless of the geographic location of the service order, the technical and/or by other means (telephone/e-mail and/or any method agreed between the parties and confirming their order placement) the order placement, its payment and/or delivery of the order took place. The use of the mentioned service by the customer automatically implies,

 

The customer is obliged to indicate in the order such a contact number/data that he can access without restriction, at least until the order is delivered. Also, he is obliged to specify in the order the address where he is actually present until he receives and takes over the order. In exceptional cases, the customer has the obligation to inform the supplier in a timely and reasonable time about any changes, so as not to prevent him from properly/honestly implementing the order delivery service. If the order's delivery address is changed at a time when the courier has already gone to the recipient's address, which was known to him before the change, the customer is obliged to pay the courier service fee to Winestory. 

 

If the customer has incorrectly/incompletely indicated the address and/or any of the delivery conditions, the supplier is not responsible for the failure to deliver such a package. In such event, the product(s) will be returned to the point of issue. 

 

If the customer wants to receive the product(s) again, because the delivery address, contact information and/or delivery address, contact information, and/or the customer was not there at the courier's arrival, despite the courier's warning to the customer, he/she shall pay only the delivery fee. the established fee. The customer can also contact the supplier through the contact information provided on the website and collect the product(s) themselves from their point of issue, if available. The supplier will not take any action until the customer himself contacts and specifies the delivery address, data and/or manually chooses the method of receiving the product. In such cases, when the non-delivery is not due to the fault of the supplier, the price of the product is not returned, And the customer can take out/receive the product at his will and through the proposed methods, according to the rules and conditions established here. If the customer does not pick up/receive the purchased product within 1 (one) month after the order, the product is considered the property of the supplier after the expiration of the mentioned period. 

 

The information posted on the Budeshuri website is constantly updated to create maximum comfort for the user. However, if, in exceptional cases, due to a technical fault and/or other circumstances, it is impossible to deliver the products specified in the order despite the order confirmation, Winestory will contact you within 2 hours of the order confirmation and will try to offer you the best alternative and/or refund the order fee (to the extent that it cannot be fulfilled product delivery). 

 

Terms of settlement

 

During registration, the user fills in the required fields, which involves linking his bank account, so that the user can place the order and make the necessary purchase for it.

 

The registered/authorized user selects the desired product from his account and follows the necessary instructions for purchase according to the rules of the website. To place the order, choose the desired bank service for payment of the order fee, and enter the card data, through which the relevant transaction will be carried out on the Winestory account. Accordingly, Budeshuri uses the services of a third party, i.e. a payment provider, to process your payment. From the moment the amount is reflected in Budeshuri’s account, Budeshuri will start preparing the products to be delivered to the addressee!

 

In the cases specified in these terms and conditions, when the supplier must return the order amount to the customer, such a statement from the supplier will be made only on the bank data from which the payment of the service fee was made and/or indicated on the registered profile at the time of placing the order.

 

Rights and obligations of the parties

Budeshuri /supplier ready:

 

  • deliver to the customer/customer the products specified in the order, by the delivery method chosen by the customer and within the time limit, to the address specified in the order;

  • to provide the customer with products of the agreed quality;

  • provide information to the customer about the status of his order;

  • to ensure proper user access to the web page, except for unforeseen/uncontrollable exceptional cases;

  • to reimburse the customer for the order not delivered due to his fault;

 

The user is ready:

 

  • control and protect your account from third parties and its illegal use;

  • to provide the website with only true and correct information about his/her person and not to allow falsification of data;

  • have permanent access to the contact information you provide when creating your profile; Otherwise, Budeshuri will not be responsible for the non-acceptance of the information shared with it on such contact link and it will be considered that the customer has been provided and notified of any such information sent/provided;

  • Not to misuse any information posted on the web page and/or for commercial purposes.

  • Not to access any kind of system/device, the purpose of which is to obtain confidential information protected on the web page. 

  • take the responsibility himself if he prevented the supplier from providing the service properly;

 

Responsibility of the parties

 

Budeshuri and its team will constantly try to ensure the smooth operation of the website and create best practices for using the online store. It should be noted that Budeshuri is not responsible for any direct/indirect damage caused to a person by negligence/negligent action. The website and its team are not responsible for any kind of damage caused by the use of the website, which is not causally related to the direct action of the supplier, whether it is technical interruption, cancellation/suspension of certain transactions, cyber security limitation, computer virus, third party influence, uncontrollable force intervention/ impact and/or other type of system failure. 

 

The user is responsible for the transactions and any kind of damages arising from the management of his/her account/profile. The user is obliged not to make his account/profile accessible to third parties, because in this case he bears full responsibility for such damage. 

 

Budeshuri cannot be held responsible for events beyond its control, whether technically, morally, substantively, factually or legally. Budeshuri is only liable for intentional damages and gross negligence arising out of and directly causally related to its actions. Damages may be imposed on the supplier to the extent that it should have performed the service to a particular customer and failed/failed to perform the service, depending on the specific order (if any).

 

Registration on the Budeshuri website can be done only by persons of legal age defined by Georgian legislation. It is not allowed to purchase products without registration/authorization, which guarantees that the legal compliance of buyers with the ordered products is controlled. A natural person, by registration/authentication, confirms that he is an adult according to the legislation of Georgia. In cases where the website is beyond the control and the order is actually made by a minor, about whom the website does not have information, because the order is actually made in compliance with all the rules, the responsibility will be borne by the owner of the account/profile from whose profile the order was placed. Budeshuri is not responsible for such and other uncontrollable cases. 

 

Budeshuri is not responsible for non-delivery of products within the delivery time due to force majeure circumstances and/or delay in the implementation of services due to third parties and/or any force/impact. Force majeure is considered to be all the relevant circumstances stipulated by the legislation of Georgia, a situation that is caused by an irresistible force and cannot be avoided (any natural event, strikes, wars, administrative acts, circumstances impeding the provision of services directly due to the pandemic situation, etc.). 

 

Budeshuri is not responsible for any direct/indirect damage caused by the use/non-use of any information posted on the web page, when such use/non-use does not serve the main purpose of the web page's operation and existence of information.

 

No returns of purchased products are permitted, except in exceptional cases expressly and precisely described in these terms and conditions.
